Florida Sues Target for Affecting Investors with Diversity Policies

Florida Attorney General James Uthmeier filed a federal lawsuit against Target, accusing the retailer of misleading investors by promoting diversity, equity and inclusion (DEI) initiatives that generated controversy and affected its sales.

The Impact of DEI Initiatives at Target

Target, known for its support of African-American and LGBTQ+ communities, faced criticism in 2023 after launching a line of products for Pride Month. The controversy prompted the company to scale back its efforts on these initiatives last month. Uthmeier argued that Target violated the Securities Exchange Act by failing to disclose the financial risks of these strategies.

“Corporations that prioritize political ideologies over profits jeopardize the financial security of Florida’s teachers and first responders,” the prosecutor said.

His office seeks to reform corporate behavior so that companies focus on their business and not political agendas.

Target’s Turnaround and the National Context

In January, the Minneapolis-based company announced the elimination of a program focused on African-American employees, customers and businesses. These initiatives came in the wake of the 2020 assassination of George Floyd, but in recent years have come under fire from conservative activists.

Target is not the only company under scrutiny. Walmart and other brands have scaled back their commitments to diversity. In early February, Missouri’s attorney general sued Starbucks, accusing it of systematic discrimination based on race, gender and sexual orientation, allegations that the company rejected.

The lawsuit against Target marks a new chapter in the debate over the role of large corporations in social and political issues in the United States.
